General

  1. The Promoter is The Uniting Church in Australia Property Trust (Q.) represented by BlueCare ABN 96 010 643 909, Level 5, 192 Ann Street, Brisbane QLD 4000 (Promoter).
  2. By entering this competition, the entrant agrees and acknowledges that they have read these Terms and Conditions and that entry into the competition is deemed to be acceptance of the Terms and Conditions.
  3. Eligibility

  4. Entry is applicable for existing BlueCare clients only – where a winner is under 18 years of age, prizes will be awarded only if the consent of their legal guardian is first given and obtained. (Eligible Entrant).
  5. Employees (and the immediate family members) of the Promoter, resellers and distributors, influencers, insiders and agencies or associated with this competition are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  6. Competition Details

  7. The Competition commences on 1 August 2020 and ends on 31 October 2020 (Competition Period).
  8. To qualify, an Eligible Entrant must register to receive electronic communications during the Competition Period via the BlueCare website (https://bluecare.org.au/paperless) or phone direct to our BlueCare Customer Service Centre 1300 258 322 to go in the draw (Standard call costs no greater than 55 cents applies).
  9. Valid and eligible entries will be accepted during the Competition Period.
  10. There is a limit of 1 entry per BlueCare client account.
  11. There will be 10 winning entries selected. They shall receive the following:
    • 1 x $100 BlueCare Credit Voucher to be applied to the winner’s BlueCare client co-payment account to be used exclusively for co-payment BlueCare services. Not applicable to services which are 100% government funded (e.g. Home Care Packaged services).
    Total prize pool value: $1,000.00.
  12. The Promoter will select at random the 10 winners. This will take place at the offices of the Promoter:
    • BlueCare
      c/- Bertha Street
      Caboolture, QLD.
    The winning clients will be notified via email or mobile by an authorised representative and announced on our social platform (Facebook). The winners must provide valid email address in order to claim their prize.
  13. All entries that are incomplete, illegible, damaged, contain an erroneous phone and/or email address, contain inappropriate or offensive content, or do not conform to or satisfy any condition of the rules may be disqualified by the Promoter at its sole discretion.
  14. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the Promoter, they forfeit the prize and the Promoter is not obliged to substitute the prize.
  15. The prize must be accepted as awarded and are not transferable, substitutable for alternative item, or otherwise redeemable for cash.
  16. The Promoter’s decisions on all matters pertaining to this competition are final and binding and no correspondence will be entered into, except as otherwise stated in these terms and conditions.
  17. Other Terms

  18. This competition is not valid in conjunction with any other offer or competition by The Promoter.
  19. Prizes are not redeemable for cash, transferable or exchangeable.
  20. The Promoter reserves the right, at any time, to amend these Terms and Conditions or verify the validity of entrants and to disqualify any entrant that is not in accordance with these Terms and Conditions. Failure by The Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. If there is a dispute, The Promoter reserves the right, in its sole discretion, to determine the validity of the claim made.
  21. Incomplete, indecipherable or illegible entries will be deemed invalid at The Promoter’s absolute discretion.
  22. The prize will be awarded to the person named in the entry and any entry that is made on behalf of an entry or by a third party will be invalid. If there is a dispute as to the identity of an entrant, The Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  23. The Promoter reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.
  24. Any cost associated with accessing the competition website is the entrant’s responsibility and is dependent on the Internet service provider used.
  25. The prize is inclusive of all taxes.
  26. Entrants consent to The Promoter using their names, words, images (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any services supplied by The Promoter.
  27. Entrants’ personal information will be collected by the Promoter. Personal information will be stored on the Promoter’s database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at https://www.bluecare.org.au/about-us/privacy-policy. The Promoter’s privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants’ personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter the Promotion.
  28. Nothing in these Terms and Conditions limits excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under other consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
  29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any tax liability incurred by a winner or client; or (d) taking/use of and/or participation in a prize.
  30. The Promoter as well as its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person’s negligence) in connection with the prize or use of the prize. This excludes any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  31. The Promoter reserves the right, in their sole discretion, to disqualify any individual they find to be:
    • a. tampering with the operation of the competition or any website related to the competition (including by creating multiple accounts);
    • b. engaging in conduct in breach of any platform’s terms and conditions;
    • c. to be acting in violation of these terms and conditions; or
    • d. to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any person participating in or connected with the competition.

These Terms and Conditions shall be governed and construed in accordance with the laws and courts of Queensland, Australia and in line with The Charitable and Non-Profit Gaming Act 1999 (category 4 games, commonly known as promotional games).
